General Terms and Conditions (GTC) of lucevivida.com
§1 Validity of the terms and conditions
These General Terms and Conditions (GTC) apply to all deliveries, services, and offers of lucevivida.com, even if they are not expressly agreed upon again in writing. By placing an order, the customer accepts these terms and conditions. The general terms and conditions of the customer do not apply, unless explicitly agreed upon in writing by lucevivida.com.
These GTC are governed by mandatory provisions of Swiss law, including applicable consumer protection legislation. Mandatory statutory rights remain unaffected. Any deviations or additional agreements are valid only if confirmed in writing by lucevivida.com.
§2 Quality
Great importance is attached to the freshness and quality of all products, and only natural raw materials are used. Whenever possible, lucevivida.com sources these raw materials from its own production or from trusted regional producers. All products are prepared in compliance with applicable hygiene regulations and are packaged and stored appropriately to preserve quality. Due to the artisanal nature of our bakery products, freshness is best enjoyed shortly after delivery. Storage instructions are provided where appropriate.
Lucevivida.com is registered with the Cantonal Laboratory for Food Safety of the Canton of Zürich under registration ID 132818 (last inspection date: 04.07.2025) and complies with all applicable food safety and hygiene regulations issued by the Canton of Zürich regarding food safety and hygiene for gastronomy businesses. Our production operates according to HACCP principles at all stages.
As our baked goods are handmade in small batches, slight variations in shape, size, or decoration may occur and do not constitute a defect.
§3 Orders
An order is considered accepted, and the sales contract is formed, once the customer receives an order confirmation from lucevivida.com by e-mail. We aim to process and ship orders as quickly as possible, with an average processing time of three (3) calendar days.
Orders for perishable food products may no longer be cancelled once production has begun.
If there are temporary shortages of raw materials or other circumstances beyond our control that may delay shipment, we will inform the customer as soon as possible and provide an updated estimated delivery date.
To ensure smooth communication, customers are asked to provide a valid e-mail address and/or telephone number where they can be reached for order-related questions.
Products are produced in small batches and may occasionally sell out without prior notice.
For Catering & Delivery services, order confirmations are subject to product availability, delivery capacity, and the explicit acceptance of lucevivida.com. Any amount paid during the checkout process for a Catering & Delivery order constitutes a provisional payment only and does not represent the final purchase price. Following a review of the order requirements, lucevivida.com will notify the customer by e-mail or text message of the final amount due. A Catering & Delivery order shall become binding only after the outstanding balance has been paid in full and confirmed by lucevivida.com.
§4 Terms of payment and prices
All product prices are stated in Swiss francs (CHF) and exclude any delivery charges, which are shown separately during the checkout process. Lucevivida.com is currently not registered for Swiss VAT because the business does not exceed the statutory turnover threshold under Swiss VAT law. Therefore, no VAT is charged or shown separately on invoices. We reserve the right to adjust our prices by up to 10% at any time without prior notice. Payment is possible by debit/credit card through the secure payment provider Stripe Payments Europe Ltd., through PayPal (Europe) S.à r.l. et Cie, S.C.A., or, on request, by prepayment. Payment authorization is requested during checkout. Depending on the payment method, the amount may be captured immediately or upon order confirmation by e-mail, text message or any other means. Seasonal products can also be ordered out of season via the item search; we reserve the right to apply a higher retail price for these out-of-season products than during the main season.
§5 Delivery
Lucevivida.com offers different delivery and collection options depending on the delivery address and the type of products ordered. Available options are displayed during the checkout process.
Products classified as fragile items (such as decorated cakes or other delicate baked goods) cannot be shipped by parcel delivery services. Such products are available only through local delivery within the designated service area or by customer collection.
Depending on the product and destination, the following delivery and collection methods are available:
Swiss Post delivery throughout Switzerland (non-fragile products only);
Swiss Post delivery with gift wrapping throughout Switzerland (non-fragile products only);
Local delivery by lucevivida.com courier for selected postal codes in and around Adliswil and the City of Zürich;
Customer collection at the lucevivida.com factory;
Customer collection at the Hardturmstrasse pick-up location.
Delivery times depend on the selected delivery method, the product type, and the delivery address and will be communicated during the ordering process.
Lucevivida.com shall not be liable for non-delivery or delayed delivery resulting from an incorrect delivery address, absence of the recipient, access restrictions at the delivery location, or force majeure. Force majeure includes, but is not limited to, severe weather conditions, natural disasters, strikes, epidemics, official orders, transport disruptions, supplier failures, and other circumstances beyond our reasonable control. In such cases, we will work with the customer to arrange a redelivery where possible.
The risk of accidental loss or deterioration passes to the customer upon delivery or collection.

§6 Inspection of goods, returns and refunds
The customer is requested to inspect the goods for completeness and condition immediately upon delivery or collection. If there are any defects, damage, or missing items, they must be reported to lucevivida.com within three (3) working days of receipt, together with a brief description and, if possible, photographic evidence.
In the case of a proven defect or incorrect delivery, the customer is entitled to one of the following remedies, at their choice:
A replacement delivery of the same product (subject to availability), or
A refund of the purchase price paid for the affected item, issued via the original payment method within seven (7) working days after confirmation of the defect.
For perishable goods such as bread, cookies, cakes, and granola, warranty claims expire after the printed expiration or best-before date. For non-perishable packaged goods (e.g., sealed granola), returns for quality reasons are accepted within fourteen (14) days of delivery, provided the goods are unopened, in their original packaging, and accompanied by proof of purchase.
To arrange a return, customers must contact lucevivida.com customer service by e-mail or phone to receive return instructions. Unless otherwise agreed, the customer is responsible for return shipping costs. Returns may also be made in person at the lucevivida.com factory shop.
Refunds or replacements will be processed once the returned goods have been inspected and confirmed to meet the above criteria.
Allergenic ingredients, including but not limited to cereals containing gluten, sesame, nuts, eggs, and milk, are clearly marked in the product details of the online store catalogue. Although every reasonable precaution is taken, all products are prepared in the same kitchen. Cross-contact with allergens cannot be completely excluded. The customer is responsible for reviewing these details before ordering. Lucevivida.com cannot be held responsible for allergenic reactions or other health-related issues arising from the consumption of its products.

§7 Data protection
Lucevivida.com respects and protects the privacy of its customers. Personal data collected during the ordering process — such as name, address, contact details, payment information, and order history — is used solely for the purposes of processing and delivering orders, handling payments, and providing customer service.
We may share necessary personal data with trusted third-party service providers (such as payment processors like Stripe or PayPal, and delivery partners) strictly for fulfilling the order. These partners are contractually obligated to handle personal data securely and in accordance with applicable data protection laws.
Customer data is stored only for as long as necessary to provide our services, fulfill legal or accounting obligations, and resolve any disputes. Once this period has ended, data will be deleted or anonymized.

For business customers, Adliswil is the exclusive place of jurisdiction for all disputes arising directly or indirectly from the contractual relationship. For consumer customers, the applicable statutory provisions on jurisdiction apply.
The contractual relationship is governed by Swiss law. Should any provision of these GTC be wholly or partially invalid, the validity of the remaining provisions shall remain unaffected. The invalid provision shall be replaced by a legally permissible provision that most closely reflects the original commercial intent.
